Terms for Buyers

These terms and conditions (Terms for Buyers) apply to Buyers of artwork, in addition to Richmond Fellowship Queensland’s (ABN 56 009 931 800) (we, our or us) terms of use (Terms) (available on our Site).

Agent: Richmond Fellowship Queensland acts as the agent for the Seller and unless otherwise stated, the sale contract of artwork is made between you (the Buyer) and the artist (the Seller). Richmond Fellowship Queensland is not the supplier or owner of any goods and receives a percentage of any artwork sold. 

Artwork condition: All artwork is sold “as-is.” Richmond Fellowship Queensland provides no guarantee with regards to the condition of artwork. It is strongly encouraged that prospective buyers satisfy themselves in terms of any information referred to in artwork listing and the artwork condition.

Artwork copyright: By purchasing artwork, the Buyer acknowledges, understands and agrees that they do not acquire any copyright or other reproduction rights.  

Artwork description: All information provided in listings. 

Artwork value: All dollar values expressed on this Site are in Australian dollars (AUD). Unless otherwise stated, all artwork is priced at the discretion of the artists.

Confirmed Sale: You, the Buyer, understand, accept and agree that when purchasing an artwork and successfully completing the online check out process (Confirmed Sale) this immediately forms a contract between you as the Buyer and the Seller to purchase the artwork.

Goods and Services Tax (GST): Artwork prices are inclusive of GST on the commission component of the sale. The commission component is 15 per cent of the sale price. As outlined in the Artist Terms and Conditions agreed to by the Seller, the Seller is responsible for any applicable GST obligations specific to their circumstances.

GST may apply to shipping and/or insurance costs. Where the Buyer requires and agrees to a shipping and/or insurance quote, any GST will be passed on to the Buyer as outlined in the third party quote. 

Insurance and shipping: Selected pick up locations are available in Brisbane, Australia, and will be available for selection at the time of check out. These locations are subject to change and we may vary these locations from time to time. 

Domestic shipping and shipping insurance can be organised at the Buyer’s expense. A quote for domestic shipping and shipping insurance (if required) will be provided after sales are processed using a selected third party transport provider. Buyers are free to organise their own shipping and shipping insurance using their preferred third party transport provider, at their own time and expense. 

Shipping outside of Australia is not available. Shipping and collection of artwork is available once the physical exhibition ends in Brisbane (from 13 October 2023). Advice on collection times will be provided to the Buyer. This is subject to vary depending on the selected pick up location or shipping requirements.

Payment conditions: Full payment of artwork is required at the time of purchase. Checkout is online via this Site and payment is available through the Shopify payment gateway using selected payment methods.

Payment methods: Richmond Fellowship Queensland provides payment services in connection with and through third party services, including Shopify and Shopify’s payment gateway. Richmond Fellowship Queensland may choose to restrict the availability of specific payment services and may introduce new payment services from time to time. 

The use of third party services for payment methods may be subject to additional fees, charges, terms and conditions. Richmond Fellowship Queensland is not responsible for any such fees and disclaims all liability in this regard. It is the Buyer’s responsibility to review, read and understand any fees, charges, terms and conditions imposed by third party services in connection with the payment services.

The use of Payment Services except as authorised by the laws of Australia and other laws as applicable, is not permitted.

Purchase on behalf of others: If you are purchasing artwork on behalf of another Buyer, you are required to ensure the other Buyer is aware of and agrees to these Terms of Use, Terms for Buyers, Refund Policy, Shipping Policy and our Privacy Policy (available on our Site) (Terms).

Release: The Buyer releases Richmond Fellowship Queensland, and its employees, directors and agents from any claim or liability arising as a result of any error, misrepresentation, fraudulent statement or action or omission of any Seller. This includes as a result of negligence.
